“In accordance with Federal Law No. 256-FZ dated December 29, 2006 “On additional measures of state support for families with children,” persons who have received maternity (family) capital (MSK) can dispose of the funds of maternity (family) capital in full or in parts in the following areas:
1. Improving living conditions.
According to the Rules for allocating funds (part of the funds) of maternal (family) capital to improve housing conditions, approved by Decree of the Government of the Russian Federation dated December 12, 2007 No. 862, funds (part of the funds) of maternal (family) capital, when used to improve housing conditions, can be directed on the:
Payment for purchased residential premises;
In payment of the price of the agreement for participation in shared construction;

However, in accordance with clause 10 (1) of the Rules for the allocation of maternal (family) capital funds to improve housing conditions, maternal (family) capital funds can be directed to the construction or reconstruction of an individual housing construction project carried out by citizens without the involvement of a construction organization.
According to paragraph 14 of Art. 1 of the Town Planning Code of the Russian Federation, reconstruction is defined as a change in the parameters of capital construction projects, their parts (number of premises, height, number of floors, area, production capacity indicators, volume) and the quality of engineering and technical support.
A change in the quality of engineering and technical support for buildings should be understood as the implementation of work to replace the types of engineering equipment of buildings that require the installation of equipment and installation of energy supply networks, gas supply, heat and water supply and sewerage, air conditioning, ventilation systems, alarms and communications, video surveillance and access to buildings, structured cable networks that allow you to receive previously unavailable services.
Thus, if there is a construction (reconstruction) permit issued to the person who received the certificate, or the spouse of the person who received the certificate, it is possible to allocate MSC funds for the reconstruction of an individual housing construction project (gas supply or water supply) in an amount not exceeding 50% of the amount of MSC funds , due to the person who received the certificate on the date of submission of the application. An application for the disposal of maternal (family) capital funds can be submitted to the territorial body of the Pension Fund of the Russian Federation at the place of residence at any time after the child, with whose birth the right to additional measures of state support arose, reaches 3 years of age.
The remaining MSC funds can be used for reconstruction after 6 months from the date of initial allocation of part of the MSC funds, subject to the requirement to carry out basic reconstruction work, as a result of which the total area of the reconstructed residential premises increases by no less than the accounting standard for the area of residential premises established in in accordance with the housing legislation of the Russian Federation."
